The old law came to my attention on a news report on TV. The old law is called Adverse Possession. This means in plane sight of all passers by and neighbors you can take over land or an abandoned house for a specified time ( time different in each state in USA ). If during this time of take over you are not kicked off the property by right full owner or cops, and have met all elements listed bellow you may become the right full new owner of the property. Be for taking over a property always consult an attorney as to what rights you have under this law. Thoroughly research intended take over sight so you know who owes it. Federal, State, Schools, and public lads set aside for recreation by the pubic can not be adversely possessed.
Elements needed for attempted ownership of property to ripen into legal title:
* Actual - occupation of property to make it solely for your self. You must trespass with out permission. You must show use of property such as planting crops or cutting trees for fire wood.
* Open and Notorious - You must posses property openly for hole world to see like a true owner would. The right full owner of the property must be made aware you are there on the land or living in a house on the land. All the neighborhood should be made aware of your occupation of the property. Nothing can be in secret.
* Exclusive - You solely must be the occupant of the entire property. entry must not be casual or accidental. entry must be peaceable but notorious as well. Abandoning the land or giving it to some one els will destroy you attempt of adverse possession.
* Statutory Period - The time period of the statute of limitations that must expire before title can be acquired by adverse possessor. This differs in each state so see an attorney and thoroughly research this law be for attempting to possess land or property.
