CITES and import paperwork is only required to import. After clearance it could be tossed. Not like business transaction records or tax records which the govt recommends be retained seven years.
It would be useful for an importer to retain records until all specimens are sold at retail just in case there is ever a problem caused by USFWS since the paperwork could prevent seizure of lawfully imported material. After it’s all been sold at retail the importer has no reason to retain paperwork and it becomes the buyers problem.
In reality retail buyers of lawfully imported material are unlikely to suffer a problem without paperwork unless they get on the USFWS radar which typically would only happen if they were up to no good anyway. That said museums are unlikely to want CITES material missing paperwork which can limit donations and tax deductions. Also as we see here potential buyers can also be wary of CITES material sans paperwork which by nature reduces demand and thus selling price.
I have elected to retain my paperwork from 15 year old imports just in case I or the buyers ever have an issue. Never happened but no harm to keep it and it’s available when the day comes that I do donate my collection. In fact i have three copies of all foreign export and US import paperwork- One close at hand because I do occasionally refer to it, one locked in a fire safe for backup, and one overseas in case some government entity decides to play games.

Wow! Three copies of import paperwork. This brings me back to my original question.....would it not be the logical thing to have in my possession a copy of CITES permits for the species I bought from a dealer here in the US, since after they are sold to me "it becomes the buyer's problem" as you stated? If they are so anal about this stuff, it's a wonder they don't track down every dealer and buyer. Maybe what Bill states is more to the point, (not that you aren't on point with the subject, it's just so frustratingly confusing to me). Perhaps it is during the actual time of shipment that they are most concerned with legal documentation. After it's already here, (in the US)- it's anybody's guess as to when or where the specimens came from. They could be from an old collection that got passed around from one collector to the next for years, even decades. Who could prove otherwise? I have a hunch that insects are probably lowest on their priority list, and it would take an army of agents to totally enforce the law anyway. With as many international wildlife transactions that take place on a daily basis, I have to wonder how they can keep up.

If I had known that I was looking at his listings, I would never have bid on the items.If you have to lie about your location, just to get sales, there is most likely something shady about you, and/or what you are selling.

This guy is bad news. Going far enough to claim that he is in the US would be beneficial for him as he has had multiple issues relating shipping costs. I would steer clear from him, and if he lies about permits, that is an instant red flag. At that rate, I would just stick to the genuine dealers on the suppliers list of insectnet.

Hello,
I have recently purchased some butterflies from this seller Peter Jakubek on ebay under the sellers account americaninsects-world but now after almost 2 weeks there is still no confirmation of shipping and its a bit confusing where and who he/she (firsts messages were replied by someone called Nel) is. I thought I was buying in the Czech Republic, but after winning it was listed as being in Helena, MT, United States. Also it was strange for me that I received second change offers for auctions that were overbid. That means it can not be the specimens from the pictures so I asked to send me pictures of the specimens that I should recieve and got these within 24 hours. After that I received an invoice through ebay and a seperate paypal invoice for a few extra butterflies that were offered. I'm just worried now if I will ever receive these. I have 20+ years experience in buying and selling on ebay worldwide and purchased many butterflies from different sellers always without any trouble but now something does not feel right... I just wonder what the latest experiences from other buyers are? I see that he/she is still listing new auctions. I googled around and this is the only forum thread I could find about this seller which is far from positive. The last reply to me on my request for tracking information was that I should not worry, it will be provided after shipping ...whenever that will be.

Hello, Thank you for your replies, I had contact again with Peter Jakubek. His explanation is that he was still traveling somewhere and not able to ship yet... He will be home again next week and ship my purchases. If thats so why not having a holiday or out of office notice on ebay? Thats what many sellers including myself always do so people know there will be delays. I noticed that he had new positive feedback so I still have some (almost no) hope...

Ebay or PayPal guarantee a refund. This is not a problem and need not be feared. Otherwise it may be worse. In any case, Petr Jakubek is the real name of the person and he really lives at the address (Czech Republic) that a member of this forum sent me.

Last friday Peter Jakubek finaly managed to send my purchases and provided a tracking number that seems to be working... I wonder what I realy would receive... the package was send from a postoffice in Bystřice nad Olší, Czech Republic. Its near both the Polish and Slovakian border.
